Terms of Service

By accessing or using FIScom AI ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms constitute a legally binding agreement between you ("User", "Customer", "you") and FIScom AI ("Company", "we", "us"). Your use of the Service is also governed by our Privacy Policy.

FIScom AI provides an AI-powered business intelligence platform that enables users to:

• Upload and analyze business data

• Generate automated reports and insights

• Access data visualization and analytics tools

• Export reports in multiple formats

• Integrate with third-party business tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To use the Service, you must:

• Be at least 18 years of age

• Provide accurate, current, and complete information

• Maintain the security of your account credentials

• Notify us immediately of any unauthorized access

• Be responsible for all activities under your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription Plans:

• Starter Plan: $49/month - For small teams (up to 100 reports/month)

• Professional Plan: $199/month - For growing businesses (unlimited reports)

• Ultra Plan: $399/month - For enterprises (all features + dedicated support)

Billing Terms:

• Subscriptions are billed monthly or annually in advance

• Annual plans receive a 20% discount

• All fees are non-refundable except as required by law

• We may change pricing with 30 days notice

• Failed payments may result in service suspension

• You are responsible for all applicable taxes

We offer a 14-day free trial for new customers:

• No credit card required to start trial

• Full access to plan features during trial

• Trial automatically ends after 14 days

• No charges unless you subscribe

• One trial per customer

• We reserve the right to modify or terminate trial offers

You may cancel your subscription at any time:

• Cancellation takes effect at the end of the current billing period

• No refunds for partial months or unused time

• Access continues until the end of the paid period

• Data export available for 30 days after cancellation

• Account data is deleted 30 days after cancellation

Refunds are only provided in cases of service failure or as required by law.

You agree NOT to:

• Violate any laws or regulations

• Infringe on intellectual property rights

• Upload malicious code, viruses, or harmful content

• Attempt to gain unauthorized access to our systems

• Reverse engineer, decompile, or disassemble the Service

• Use the Service for illegal activities or fraud

• Resell or redistribute the Service without authorization

• Scrape, crawl, or harvest data from the Service

• Interfere with or disrupt the Service

• Impersonate others or provide false information

Violation of this policy may result in immediate account termination.

Your Data:

• You retain all ownership rights to data you upload

• You grant us a limited license to process your data to provide the Service

• We do not claim ownership of your data

• You are responsible for ensuring you have rights to upload data

Our Platform:

• FIScom AI and all related intellectual property are owned by us

• You receive a limited, non-exclusive license to use the Service

• This license terminates upon subscription cancellation

IMPORTANT - Please read carefully:

• AI-generated reports and insights are provided "as is"

• We do not guarantee 100% accuracy of AI outputs

• AI models may produce errors, inaccuracies, or incomplete information

• You must review and verify all AI-generated content before use

• Do not rely solely on AI outputs for legal, financial, or compliance decisions

• Consult qualified professionals before making business-critical decisions

• We are not liable for decisions made based on AI-generated content

• You assume all risk and responsibility for using AI outputs

Professional Responsibility:

You acknowledge that AI is a tool to assist, not replace, professional judgment. All reports and insights must be reviewed by qualified personnel before being used for professional purposes.

We strive to maintain high availability:

• Starter & Professional Plans: 99.9% uptime

• Ultra Plan: 99.99% uptime

• Scheduled maintenance excluded from SLA

• SLA credits available for Ultra customers upon request

• We are not liable for downtime caused by third-party services or force majeure

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" and "AS AVAILABLE"

• We disclaim all warranties, express or implied

• We are not liable for indirect, incidental, or consequential damages

• Our total liability is limited to fees paid in the 12 months prior to the claim

• We are not liable for data loss (maintain your own backups)

• We are not liable for third-party integrations or services

• We are not liable for business losses, lost profits, or lost data

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless FIScom AI from any claims, damages, or expenses arising from:

• Your use of the Service

• Your violation of these Terms

• Your violation of any laws or third-party rights

• Data you upload to the Service

• Decisions made based on AI-generated content

We implement industry-standard security measures:

• AES-256 encryption, SOC 2 Type II certification

• Regular security audits and penetration testing

• In the event of a data breach, we will notify affected users within 72 hours

• We will cooperate with authorities as required by law

However, no system is 100% secure. You acknowledge the inherent risks of internet-based services.

We may suspend or terminate your account if:

• You violate these Terms

• Your payment fails

• We are required to do so by law

• We discontinue the Service (with 90 days notice)

Upon termination:

• Your access to the Service ends immediately

• You have 30 days to export your data

• All data is permanently deleted after 30 days

• No refunds for remaining subscription time

We may update these Terms from time to time:

• Material changes will be notified via email

• Continued use after changes constitutes acceptance

• If you do not agree to changes, you must cancel your subscription

• Changes are effective 30 days after notification

These Terms are governed by the laws of North Macedonia:

• Disputes will be resolved in accordance with North Macedonian law

• Parties agree to attempt good faith negotiation before pursuing legal action

• Jurisdiction for legal disputes shall be the competent courts of North Macedonia

• EU consumer protection laws apply where applicable
